CHILD LABOR LAWS

 

Entertainment Work Permit: All minors must have a valid work permit and bring it with them to the job site. Employers must have a permit to employ minors on file with the Division of Labor Standards Enforcement. Blanket permits may be granted for large groups of minors such as baseball teams, marching bands, etc.

Materials: School age minors are required to bring books, assignments, paper and writing utensils from regular school. Employers are required to provide adequate school facilities i.e., tables, chairs, etc.

Parent or Guardian: Must be within sight or sound for all minors under 16 years of age.

Studio Teacher/Welfare Worker: A Studio Teacher/Welfare Worker must be provided for the education of all minors (up to 18 years) and has the responsibility for caring and attending to the health, safety, and morals of all minors under 16 years of age. A studio teacher must be certified by the California Division of Labor Standards Enforcement.

Minors per Studio Teacher: 1 to 10 on school days and 1 to 20 on non-school days.

Babies: For babies 15 days to 6 weeks a Nurse and a Studio Teacher must be present for every three babies. For babies 6 weeks to 6 months a Nurse and a Studio Teacher must be provided for every 10 babies.

Meal Period: A minor cannot work for more than 6 hours without a meal period of no less than 1/2 hour.

Travel Time: Studio to location to studio counts as part of a minor's work day. (To minimize loss of work hours children should report directly to local location.) When on a distant location with overnight a grace period of 45 minutes each way from hotel to shoot location is not counted towards work time.

Turn Around: Twelve hours must elapse between a minor's dismissal and next day call time or school start time otherwise a minor must be schooled at employer's place of business.

Waivers: Minors 14 - 18 may work up to 8 hours a day for a maximum of 2 consecutive days with permission from school authorities.

Extensions: Requests must be submitted in writing to the Division of Labor Standards Enforcement 48 hours in advance.

Emancipation: Regulations are fully applicable to emancipated minors except for minors 16 - 17 who have obtained a high school proficiency certificate.

Work Day: Any minor may work between 5 am and 10 pm on nights before school days. 5 am and 12:30 am on nights before non-school days.

Outside of California: California laws are fully applicable when taking minors out of the state including the use of a California Certified Studio Teacher. Out of state minors working in California must also adhere to Title 8 and must obtain a California Entertainment Work Permit.
